Terms of Service

1. Acceptance of Terms

By accessing ClawVPS services, you confirm that: you are at least 18 years of age, you are not prohibited from using the services under applicable law, all information you provide is accurate, and you authorize us to process your data in accordance with our Privacy Policy.

2. Description of Service

ClawVPS provides managed infrastructure for hosting, managing, and scaling OpenClaw AI agents. Our platform enables users to deploy AI assistants on optimized cloud servers without managing underlying infrastructure.

Core services include: AI Agent Hosting, Gateway Management, Model Integration (OpenAI, Anthropic, Google, etc.), Channel Configuration (Discord, Telegram, etc.), Monitoring Dashboard, Scaling Tools, and Elevated Mode with safety controls.

We may offer access to beta features or experimental functionality from time to time. Such features are provided "as-is" and may be modified or discontinued at our sole discretion.

3. Account Registration

You must create an account with accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any unauthorized access.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Acceptable Use Policy

You agree to use ClawVPS only for lawful purposes. Prohibited activities include:

• — Hosting or distributing illegal content
• — Creating or distributing harmful content
• — Fraud, deception, or scam activities
• — Malware distribution or system exploitation
• — Spam or unsolicited bulk communications
• — System abuse or resource exploitation
• — Unauthorized access to any systems
• — Bypassing or circumventing security measures

AI-Specific Restrictions: You may not use AI agents to generate content for illegal purposes, create deceptive AI personas to impersonate real people, automate harmful interactions, attempt to extract proprietary AI models, or use the platform to train AI models without authorization.

5. Fees and Payment

Subscription fees are billed monthly or annually per your selected plan. All payments are processed securely through Stripe. Monthly plans are non-refundable. Annual plans may be eligible for prorated refunds within 30 days of purchase.

Failed payments may result in service suspension. We reserve the right to change pricing with 30 days advance notice. You are responsible for all applicable taxes.

6. Intellectual Property

ClawVPS and its original content, features, design, and technology are owned by us and protected by intellectual property laws. You retain ownership of all content you create or transmit through ClawVPS including AI agent configurations and your data.

Our trademarks (ClawVPS, ServerAvatar) may not be used without prior written consent.

7. Service Availability

We strive for 99.9% platform availability but cannot guarantee 100% uptime. Scheduled maintenance will be communicated at least 48 hours in advance when possible. Emergency maintenance may occur without advance notice for critical security issues.

Support Response Times: Basic Plan (email, 48h response), Standard Plan (email/ticket, 24h response), Pro Plan (priority email/ticket, 8h response).

8. Data and Backup

You retain full ownership of all data you upload or process through ClawVPS. Regular automated backups are performed based on your plan. Backup retention varies from 7 to 30 days by plan type.

Upon account termination, you have 30 days to request a full data export. After 30 days, all data is permanently deleted from our systems.

9. Third-Party Services

Our platform integrates with third-party AI providers (OpenAI, Anthropic, Google, etc.), Stripe for payments, and messaging platforms (Discord, Telegram, WhatsApp, etc.). Your use of these services is subject to their respective terms of service.

We are not responsible for the availability, accuracy, or practices of any third-party services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLAWVPS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless ClawVPS, ServerAvatar, and their affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You submit to the exclusive jurisdiction of the courts located in India for the resolution of any disputes.

13. Dispute Resolution

Before initiating any formal dispute resolution, you agree to first contact us at support@clawvps.ai to attempt to resolve the issue informally.

If we cannot resolve the dispute within 30 days, either party may proceed with formal arbitration or litigation.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary. The remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Acceptable Use Policy, constitute the entire agreement between you and ClawVPS. They supersede all prior agreements, understandings, and communications, whether written or oral.
